Motion 1
(a) new 5 day category membership (Monday-Friday) from 2011 onwards.
(b) Sec 2 of the Club's Constitution be amended accordingly.
(c) Members of this new category will have no voting rights and will not be eligible to play in the Club competitions other than semi opens or open competitions.
(d) This category shall be open to new entrants to Enniscorthy Golf Club
(e) Membership shall also be open to former members of Enniscorthy Golf Club who have been absent from membership for at least 1 year.
(f) Membership shall be limited to one three year period during or after which those wishing to continue membership of Enniscorthy Golf Club may apply for full membership according to normal procedures
(g) Handicap procedures shall reflect normal practices
(h) the terms of reference for this new category shall be subject to annual review
(i) applicants must follow entrance as laid down in Enniscorthy Golf Club constitution
(j) The fee for the year 2011 shall be €450


Motion 2
(a) That Enniscorthy Golf Club introduce a new category of membership, namely "Distance Membership" from 2011 onwards.
(b) that Sec 2 of the Club Constitution be amended accordingly
(c) This category of membership shall be open to new entrants who reside outside an 80km radius of Enniscorthy Golf Club
(d) It will also be open to former members of Enniscorthy Golf Club who have been absent from membership for at least one year.
(e) members of this category will have no voting rights
(f) Applicants must follow entrance regulations as laid down in Enniscorthy Golf Club constitution
(g) handicap procedures shall reflect normal practice
(h) The fee for the year 2011 shall be €399.

CONSTITUTION OF ENNISCORTHY GOLF CLUB

Definitions: -
1. The “Men’s Club” shall mean the group of male amateur golfers operating under a constitution acceptable to the Golfing Union of Ireland and to which such Club is affiliated.
2. The “Ladies Club” shall mean the group of female amateur golfers operating under a constitution acceptable to the Irish Ladies Golf Union and to which such Club is affiliated.
3. The “Parent Club” shall mean the Club formed through the amalgamation of the two groups of amateur golfers defined in clause 1 and 2 above for the purpose of managing matters of common interest (other than the game of golf and its related activities) of both the Men’s Club and the Ladies Club including the provision and maintenance of the facilities owned by or available for use by the members. The Parent Club cannot become affiliated to either the Golf Union of Ireland or the Irish Ladies Golf Union.

4. The name or title “Club” without qualification, shall mean either the Men’s Club or the Ladies’ Club or the Parent Club where the context so admits or requires.

Name of Club:
1.1 The name of the Club shall be “The Enniscorthy Golf Club”.


Objects:
1.2 The Parent Club shall: -

(a) Provide facilities for the playing of and the promotion of the amateur game of golf by men and women and generally promote amateur games and other social activities amongst its members.
(b) Manage matters of common interest of both the Men’s Club and the

Ladies Club which shall include: -
(i) Provision of and responsibility for the maintenance and upkeep of the course and clubhouse and their environs, to the standard required by members:
(ii) Provide Bar and Catering facilities and all these entail;
(iii) Set and collect annual Club subscriptions, entrance fees and other Club levies payable by members. Any alteration in these rates shall be decided at an Annual General Meeting or Special General Meeting of the Parent Club:
(iv) Generally to act in the promotion and advancement of the interests of the Club and the improvement of the facilities available to members.


Rules of Golf:
1.3 The rules of golf as approved from time to time by the R& A Rules Limited (except where varied by local rules) shall be the rules of golf for the Club.


2. MEMBERSHIP
2.1 The Club shall consist of members within the following categories of membership.
Full members – Men& Women. The right to vote at Annual and Extra-ordinary General Meetings and to hold office and/or be elected to the management committee is confined to members of this category.

Lady Members - No further members shall be admitted to this category on or after the 1st day April 1998.
Student members – aged over 18 years in full – time education.
Junior members – who shall be aged between 10& 18.
Juvenile Members – who shall be aged 8 to 10 and who shall only be entitled to use of the course in the company of an adult.
Family Membership – which shall be divided into two categories:
F1 shall comprise husband and wife and where both shall be full members of the Club.
F2 shall comprise husband and wife where the husband shall be a full member and the wife a Lady member.
Honorary Members – who may be elected by the management committee for a period not exceeding one year.
Honorary Life Members – who may be elected by the management committee on the grounds of his or her distinction in the game or in public life or public service, or service to the club and such members shall be entitled to vote and hold office and be elected to office.
Pavilion Members – members will be confined to use and enjoyment of the facilities of the Clubhouse.
Temporary (Social) Members – open to all persons actively involved in such additional activities as may be promoted by the Club. They may be admitted for periods of not exceeding one year.
K1 Corporate Membership: these shall comprise firms, companies, and businesses, which shall have the right to nominate three named individuals to full membership in each year.
K2 Such nominees shall not be entitled to membership in their own right, unless they are elected to membership subsequent to individual application.
K3 The entrance fee to such Corporate Membership shall be such figure determined by the management committee being not less than 10 times the entrance fee for a full member.
K4 The number of Corporate Members shall not exceed 10 and no new corporate member shall be admitted unless there is a vacancy.
K5 The subscription of such corporate members shall be three times the subscription of a full member.


Overseas Membership:
L1 this category is confined to persons non resident in the Republic of Ireland. The word “residence” shall be given its ordinary natural meaning and shall be defined as a person whose permanent abode is not in the Republic of Ireland.
L2 A person in this category shall not be entitled to membership of any other category unless elected subsequent to application.
L3 If any person in this category becomes resident in the Republic of Ireland he or she shall cease to be a member.

Probationary Period:
M1 Persons elected to any category of membership shall be deemed to be probationary members for a period of twelve months from the date of admission. During that period they shall be regarded as Temporary Members (Category J) with entitlement to use of the course.
M2
The management committee at its discretion shall have the power to extend the probationary period for any person not exceeding a period of two years in all.
M3 On the expiration of the said twelve month period (or two year period if relevant) the management committee may at its discretion (without being bound to do so) admit the member to the category determined by the committee and thereupon the person shall become a member of that category.
M4 In the event that the management committee declines to elect such person to membership of any category the person shall be refunded the entrance fee paid but not the subscription(s).


MEMBERSHIP APPLICATIONS

2.2 The person seeking admission as a member of any category other than honorary shall complete and sign the prescribed application form which must be returned to the Hon. Secretary. The applicant must be proposed and seconded by two paid up full members, who have been full members of the Club for at least five years.

2.3 The name and address of such person as the management committee propose to elect to be a member of the Club together with the names of those proposing and seconding him or her, shall be displayed in a prominent place for at least two weeks before election. An interval of not less than four weeks shall elapse between nomination and consideration for election.

2.4 The election of members shall be in the hands of the management committee.

2.5 The management committee shall have absolute discretion as to the admission or non- admission of applicants for membership. A secret ballot concerning the admission or non- admission of a member may be held at the request of any two committee members.

2.6 When a candidate for membership has been elected, the Hon. Secretary shall notify him or her of the fact, sending him or her a copy of the constitution. No persons shall be considered a member until his or her first subscription has been paid and payment of such subscription shall be deemed to bind the applicant to the constitution and regulations of the club, and payment of the entrance fee.

2.7 Persons elected after the 1st October shall be liable to pay full entrance fee, but shall only be liable for half the annual subscription.

2.8 The management committee may at it’s sole discretion close membership of the club from time to time, as it considers necessary. The management committee may by majority of three fourths of those present, give priority to any candidate whose election they consider any advantage to the club.

2.9 Any member whose subscription is unpaid on the 1st day of April, shall cease to be a member of the Club, but the management committee may re- elect him or her without any entrance fee and without re-nomination, within twelve months from the date of when his or her subscription arrears and other monies became due to the club.

2.10 The management committee shall have power to grant leave of absence for such period as the management committee sees fit, to a member, and thereby release such member from liability to renew the annual subscription for the period. During the period of leave permitted, the member’s name shall be removed from the Register of Members, and transferred to the non- active list. A member shall notify the management committee of his or her desire to avail themselves of this rule and it shall be his or her duty to apply for reinstatement of membership of the Club at the expiration of the aforesaid period, and if he or she shall omit to do so, his or her membership shall be deemed to have lapsed.

2.11 Any members wishing to withdraw from the Club shall notify the same in writing, to the Hon. Secretary, prior to the 1st April, in default of which he or she shall be liable for the subscription for that year.

2.12 Members may on application, in writing to the Hon. Secretary, and subject to approval of the management committee, be transferred to any category of membership without re-election and on payment of the full entrance fee and subscription applicable to the category of which they are being transferred, credit being given for any entrance fee already paid, excepting only junior members, who become full members.






2.13 A list of the members of the club shall be posted in the clubhouse clearly showing subscriptions paid up to the end of the previous month. Candidates for membership who had previously held membership of the club shall be liable for any levies or fines imposed on the membership within the period for which they had allowed their membership to lapse.


SUBSCRIPTIONS

3.1 The annual subscription of members, other than Honorary Members, shall be decided at the annual General Meeting. Subscriptions are payable in advance on January the 31st.

3.2 Any members whose annual subscription is not paid prior to January 31st, in any calendar year, shall cease to be a member on that date and shall not be eligible to participate in the games of any section of the club or to partake in any section of the club, or to partake in any of the privileges attached to members.

4.1 The Officers of the Clubs shall be: -

4.2 The immediate Past Captains shall be deemed ex-officio to be a


member of the Ladies or Men’s Club committee for the year succeeding his/her year of office






4.3 The election of the Officers and Committees shall take place at


the annual General Meeting or in exceptional circumstances at an Extra-Ordinary General Meeting.






4.4 The Officers of the Club shall hold office for a period of one


year, and shall be eligible for re-election.






4.5 No officer of the Club shall hold more than one office in his/her


year of office.









The Management Committee






5.1 With effect from 11th December 2005 the business affairs of the


Parent Club shall be managed by a Committee known as “The Management Committee” consisting of: -

The Ladies’ Captain


The Men’s Vice-Captain


The Ladies’ Vice-Captain


The Honorary Secretary


The Honorary Treasurer


Four Full Members






The management committee shall hold monthly meetings and at such times as may be found necessary.






5.2 All members of the management committee shall retire at the A.G.


M. and shall be eligible for re- election for the year then ensuing. The election of the members of the management committee shall be by ballot.


The management committee shall have power to fill vacancies in their number during the year, but such members so co-opted shall only hold office, until the ensuing Annual General Meeting, when such vacancy shall be filled by ballot of the members of the club in accordance with the constitution.






5.3 At the meetings of the management committee seven shall form a


quorum. The chair shall be taken by the Captain, or in his absence by the Vice–Captain, or if none of those Officers be present, any member may be elected Chairman. The Chairman shall have a casting vote in addition to his own vote.






5.4 Four days notice of every management committee meeting shall be


given in writing to each member of the committee by circular, specifying the time and place of meeting and of the business to be transacted, which shall be and set out in an agenda.






5.5 Minutes shall be kept and proper books of all resolutions and


proceedings by the management committee, and every Minute signed by the Chairman of the next meeting shall be sufficient evidence of the facts therein stated.






5.6 Decisions of the management committee shall be noted and filed in


an orderly and accessible manner. For the purpose of this paragraph, the word “decision” shall mean, judgements or rulings of the committee made under this constitution and decisions made in relation to the Course or members.






5.7 The management committee shall have power from the time to time


to make regulations consistent with the constitution, relative to the use of the clubhouse and Course by members and visitors.






5.8 Correct account books and records shall he kept in the


Secretary’s office or such other places or places the management committee may direct, showing the financial affairs, receipts and disbursements of the property of the Club.






5.9 The banking accounts shall be kept in the name of the club in


such bank as the management committee may from time to time determine.


All cheques shall be signed by two members of the management committee who shall be designated from time to time by the management committee.


All accounts and books shall be open to inspection by any member of the management committee at all reasonable times.






6. The Men's Club






6.1 The business and affairs of the Men’s Club shall be under the


jurisdiction and control of the Men’s Club Committee, which shall comprise the following: -

Competitions Secretary


Together with five male members






The Objects of the Men’s Club shall be to: -






6.2 Promote the Amateur Game of Golf amongst its Members.






6.3 Be affiliated to the GUI, accept and be bound by the GUI


Constitution, conform with the GUI Bye-Laws, and in compliance with the GUI Constitution, to pay by the due date each year to the GUI, an annual subscription for every male member entitled to play golf, in the categories prescribed.






6.4 Accept and conform with the Bye-Laws of the Leinster Branch of


the GUI, and pay by the due date each year, to the Leinster Branch of the GUI, an annual levy for every male Member entitled to play golf, in the categories prescribed.






6.5 Accept and comply with the Standard Scratch Score and


Handicapping System, as prescribed by the Council of National Golf Unions (CONGU), and such rules there under as may require to be implemented from time to time by the GUI.






6.6 Accept and comply with the Rules of Golf and the Rules of Amateur


Status as approved by the Royal& Ancient Golf Club of St Andrews.






6.7 The Men’s Committee shall hold monthly meetings and at such times


as may be found necessary. The Quorum shall be 7.






6.8 The Management Committee shall have general control over the


finances of the Men’s Club. The Men’s Club shall submit accounts to the Management committee annually or when required. All monies to be handed to the Honorary Treasurer of the Club.










7. The Ladies Club






7.1 The business and affairs of the Ladies Club shall be under the


jurisdiction and control of the Ladies Club Committee which shall comprise of the following;

Ladies’ Secretary


Ladies’ Treasurer


Ladies’ Handicap Secretary


Ladies’ Competition Secretary

The Objects of the Ladies’ Club shall be to:






7.2 Promote the Amateur Game of Golf amongst its Members.






7.3 Be affiliated to the ILGU, and accept and be bound by all Rules


and Regulations of the ILGU and in compliance with such Rules, pay by the due date each year, to the Honorary Treasurer of the ILGU, an annual subscription for every female Member entitled to play golf, in the categories prescribed.






7.4 Accept and conform with the Bye-Laws of the Midland District


Branch of the ILGU and pay by date each year, an annual levy to the Honorary Treasurer of the District, for every female member entitled to play golf, in the categories prescribed.






7.5 Accept and comply with the Scratch Score System and the


Handicapping System as prescribed by the ILGU and such rules there under, as may be required to be implemented from time to time by the ILGU.






7.6 Accept and comply with the Rules of Golf and the Rules of Amateur


Status as approved by the Royal& Ancient Golf Club of St Andrews.






7.7 The Ladies committee shall hold monthly meetings and at such


times as may be found necessary. The Quorum shall be 7.






7.8 The Management committee shall have general control over the


finances of the Ladies club. The Ladies Club shall submit accounts to the Management committee annually or when required. All monies to be handed to the Honorary Treasurer of the Club.






8 GENERAL MEETINGS






8.1 The Annual General Meeting of the Club shall be held in


December of each year on a date appointed by the management Committee.


Notice of the meeting shall be posted in the clubhouse at least twenty-one days before the date of the proposed meeting as well as sending notice of the meeting to each full member.










8.2 The accounts of the Club shall be audited by a public accountant


before the Annual General Meeting. A copy of the accounts and statement of the accounts for the past year shall be sent to each member with notice of the Annual General Meeting.






8.3 The President shall take the chair at all general meetings of the


Club. In the absence of the President, the Vice-President, the Captain, the Vice-Captain or some member of the committee shall move to the chair in that order. The Chairman shall have a casting vote in addition to his own.






8.4 The Business of the Annual General Meeting shall be;


a) Minutes of the previous Annual General Meeting.


b) Annual report submitted by the Captain


c) Finance Statements submitted by the Hon. Treasurer


d) Notice of Motion


e) Election of the Officers and Members of the management committee


f) General Business






8.5 An Extraordinary General Meeting of the Club shall he called by


the Hon. Secretary, at within fourteen days of being directed by the management committee or demanded in writing by not less than fifty full members, who in their requisition, shall state the object of such meeting. No other business shall be transacted at the extraordinary meeting. Notice of such meeting shall be posted in the clubhouse and at least seven days before the date of the proposed meeting, notice shall be sent to each member.






8.6 Sixty full members entitled to vote shall constitute a quorum at


a general or Extra-Ordinary Meeting of the Club. In the event that a quorum is not present within thirty minutes of the appointed time, the meeting shall stand adjourned to the same place and time the following week and that any such adjourned meeting the quorum shall remain at sixty full members. At an Annual or Extra-Ordinary General Meeting the voting shall be simple majority of those present and entitled to vote.






8.7 At an Annual or Extra-ordinary General Meeting the voting shall


be simple majority of those present and entitled to vote.






8.8 Alterations and additions to this constitution may be made at any


General Meeting or at an Extra-Ordinary General Meeting called for the purpose, provided that the resolution proposing same is carried by a vote of two thirds of the members present and voting.






8.9 Full members wishing to propose alterations or additions to this


constitution must send notice of proposed alterations or additions by writing to the Hon. Secretary, seven days before the annual general meeting or may do so by calling an Extra-Ordinary General Meeting as provided for in the constitution.






9. VISITORS






9.1 A member may introduce a visitor to the facilities of the


clubhouse and the course at any time subject to conditions which the management committee shall approve. Members introducing visitors must enter the names of the visitors and address in the Visitors Book as well as dating and singing the book and procuring a voucher where necessary.


A visitor shall not be served excisable liquor on the premises unless at the invitation of a member.






9.2 Members of the recognised Golf Clubs or Societies who are


introduced to the Club under the immediate preceding rule or visit the Club to play golf, shall be temporary members during the day(s), when entitled to play over the Course.






9.3 No excisable liquor shall be sold or supplied for consumption on


or outside the club premises, except to members, save in accordance with the Intoxicating Liquor Acts in force for the time-being.






9.4 The management committee shall have the power to suspend the


rules permitting introduction of visitors or temporary members at any time they may think fit and to refuse permission to any visitor or temporary member to use the Club premises. (In the event of visitors omitting to make payments due by them in respect of green fees, the member introducing them shall be liable for payment of same).






9.5 The management committee may for such period, as it thinks fit,


withdraw the use of the club-house and course from any visitor, who in the opinion of the management committee, has infringed any rule of the Club.






10. DISCIPLINE






10.1 The management committee shall have the power to expel or


suspend from club activities, any member of the Club, whose actions are, in the opinion of the committee, prejudicial to the interest of the Club.






10.2 If, in the opinion of the management committee, any member by


conduct or otherwise, brings upon or causes discredit to the Club, endangers the welfare or good order of the Club, its members or property, the committee shall enquire into such conduct or such other matters. Written notice of such inquiry shall be given to the member concerned, who may attend such inquiry.






10.3 In the event of a management committee decision to discipline a


member, such member shall have a right to be heard at the next meeting of the committee, provided that he/she gives notice in writing of his/her intention to appear before the committee, within seven days of the receipt of the decision by the committee, in relation to his/her discipline.






10.4 The member shall have the right to be represented and make


submissions at any such hearing. The decision of any such hearing shall be final.










11. ASSETS AND TRUSTEES






11.1 The club shall have power to acquire, hold, to sell, lease,


mortgage, or charge, real and personal property. Real property shall not be transferred, sold, leased, conveyed, mortgaged or otherwise charged or dealt without the consent and approval of the Management committee or without the approval of the Extra-ordinary or Annual General Meeting of the Club.






11.2 The real property of the club shall be vested in two or more


members as trustees, who shall hold same in accordance with the rules hereof.






11.3 The Committee shall appoint the trustees and to any vacancy


arising, and the trustees shall hold office until death, resignation or incapacity.






11.4 The trustees in office at the date of adoption of this


constitution shall continue in office.






11.5 The trustees shall be under no personal liability to the bank or


lender in respect of any pledge, mortgage or charge by the Club. All present and future members of the club shall be deemed to have assented to the creation by the trustees, of any security entered into, or deposit made by them, by virtue of the rules.






11.6 The Club shall indemnify, and save harmless, a trustee in


respect of any loss or out-of-pocket expenses bona fide incurred by him, in or about the execution of his trust or powers.










12. REGISTRATION OF CLUBS ACTS






12.1 No excisable liquor shall be supplied for consumption on the


Club premises to any person (other than a member of the Club lodging in the Club premises) or be consumed on the Club premises by any person (other than a Member of the Club lodging in the Club premises):


(a). on any Monday, Tuesday or Wednesday, before the hour of 10.30


o’clock in the morning and after 11.30 p.m.


(b). on any Thursday, Friday or Saturday before the hour of


10.30 o’clock in the morning and after 12.30 a.m. on the following day.


(c). on any Sunday, before 12.30 p.m. and after 11.00 p.m.


(d). on St. Patrick’s Day, before 12.30 p.m. and after 12.30 a.m.


(e). at any time, on Christmas Day or Good Friday.


(f). the 23rd of December if it falls on a Sunday, between 10.30


a.m. and 11.30 p.m.


(g). Christmas eve, and the eve of Good Friday between 10.30


a.m. and 11.30 p.m.


(h). the eve of any public holiday (other than Christmas eve);


(i). If the eve falls on a weekday, between 10.30 a.m. and


12.30 a.m. on the following


day or


(ii). if it falls on a Sunday, between 12.30 p.m. and 12.30


a.m. on the following day.






12.2 Nothing in the Registration of Clubs Acts 1904 to 1999, in the


rules of a Club registered under these acts, shall operate to prohibit the supply for consumption on the club premises of excisable liquor to any person, or the consumption of excisable liquor on those premises by any person:


(a). on Christmas day between 12 midday and 10.00 p.m. or


(b). on any other day, for one hour after the expiration of any


period in respect of that day during which it is lawful for the Club to supply any excisable liquor, or consumption on the club premises if in each case the excisable liquor is:-


(i). Ordered by or on behalf of that person at the same time


as a substantial meal is so


ordered.


(ii). consumed by that person during the meal or after


the meal has ended.






12.3 No Officer or Member of the Committee, or Servant or employee of


the club shall have any personal interest in the sale to the club of supplies of liquor, minerals, food or goods of any description, or in the profits arising from such sale.
